References to ProxiVie (or “we”) also include companies providing services to ProxiVie, ProxiVie family companies and our business partners, to the extent that these parties collect, use or share personal information for or on behalf of ProxiVie. This privacy policy applies to information collected by these companies only when they provide it to ProxiVie.

We encourage you to read this Privacy Policy carefully when using our website or services or when conducting business transactions with us. By using our website, you are accepting the practices described in this privacy policy.

We may change this Privacy Policy from time to time. If we make any changes, we will notify you by posting the updated Privacy Policy on our website and updating the effective date at the top of this Privacy Policy. If we make material changes, we may provide additional notice to you (such as adding a statement on our website or sending you an email notification). PERSONAL INFORMATION COLLECTED

Information necessary to use the ProxiVie Platform.

We collect personal information about you when you use the ProxiVie Platform. Without them, we would not be able to provide you with the requested services. This information includes:

Contact Information, Account and Profile Information.

  • Personal data (surname, first name, date of birth);
  • Company data (NEQ, #TPS, #TVQ);
  • Contact details (telephone number, email address, postal address);
  • ProxiVie Account information (username and password);
  • Your profile picture, depending on the features you use.

Identity verification and payment information.

  • Images of your identity document (in accordance with applicable legislation),
  • Your ID number
  • Other necessary verification information regarding your bank account or payment account.

Information collected automatically when using the ProxiVie Platform and our Payment Services.

When you use the ProxiVie Platform and the Payment Services, we automatically collect personal information. This information may include:

  • Technical information collected about your computer or mobile device (e.g. your IP address, browser type, operating system).
  • Login Data and Device Information. Information on how you used the ProxiVie Platform (in particular if you clicked on links to third-party applications). Information about your use of our Websites (e.g., the pages you visit when you use the Services, the search terms you use on the Services, your reservations and other actions taken on the ProxiVie Platform, your frequency of use of the Services and the pages you access before and after accessing the Services). We may collect this information even if you have not created a ProxiVie account or logged in.

ProxiVie uses cookies, mobile service identifiers, tracking URLs, data logs and similar technologies to help provide, protect and improve the ProxiVie Platform.

Why ProxiVie uses these technologies. We use these technologies for various reasons, for example to:

  • Enable you to access and use the ProxiVie Platform and Payment Services
  • Enable, facilitate and simplify the operation of the ProxiVie Platform and your access to it.
  • Better understand how you can navigate and interact with the ProxiVie Platform and improve it.
  • Monitor and analyze the performance, operation and effectiveness of the ProxiVie Platform and advertisements.

When you visit the ProxiVie Platform, we may place cookies on your device. Web beacons, web beacons and tracking URLs are tiny graphic images and small blocks of code placed on web pages, ads or in our emails that allow us to determine whether you have taken a specific action. When you visit these pages or open an email, they tell us. These tools allow us to measure the response to our communications, and to improve our web pages and promotions.

Third-party social media plug-ins

The ProxiVie Platform may use social media plug-ins provided and operated by third parties, such as the Facebook “Like” and “Share” button. Consequently, the third party may have access to the information you consult on a certain part of the ProxiVie Platform. If you are not connected to your account opened with the third party, the latter will not be able to identify you. If you are connected to your account opened with the third party, then the latter may link the information or actions relating to your interactions with the ProxiVie Platform to the account you hold with the third party in question. Please review the relevant third party's privacy policies to inform yourself of their data practices.

Payment transaction information.

Payment method used, date and time, payment amount, payment method expiration date and billing zip code, PayPal email address, Stripe information, your address, and others associated transaction information.

Personal Information Collected from Third Parties.

Background check. To the extent permitted by applicable law and with your consent where applicable, we may obtain the local equivalent of a criminal record check or a sex offender register entry. We may use your information, including your full name and date of birth, to obtain these reports.

Create and maintain a secure environment of trust.

We use personal information to:

  • Detect and prevent fraud, spam, abuse, security incidents and other harmful activities;

In a limited number of cases, automated processes may restrict or suspend access to the ProxiVie Platform if the processes listed above detect activity that we believe poses a security or other type of risk to the platform. Providing, personalizing, evaluating and improving our advertising and marketing of our services.

When permitted by law, we may use certain information about you, such as your email address, anonymize it and share it on social network platforms, in order to generate leads, traffic to ProxiVie or even promote our products and services in any other way.

Information You Post in Profiles, Listings and Other Public Information.

You can make certain information publicly visible to other users, such as:

  • Your public profile page, including your profile photo, first name, description, certification, experiences and city;
  • Your availability, profile picture and additional information you choose to share;
  • Comments, ratings;
  • Content in or a discussion or community forum, blog or social media post.

We may display certain parts of your public profile and other content that you make available to the public such as detailed information about third party sites, platforms and applications.

The information you share publicly on the ProxiVie Platform may be indexed through third-party search engines.

Compliance with laws, responding to legal requests, preventing harm and protecting our rights.

We may disclose your information to courts, law enforcement authorities, governmental or public authorities, tax authorities, or authorized third parties, if and to the extent that we are required or permitted to do so by law, or where disclosure is reasonably necessary: ​​(i) to comply with our legal obligations; (ii) to comply with a valid legal request or to respond to claims brought against ProxiVie; (iii) to respond to a valid legal request in connection with a criminal investigation into suspected or illegal activity, or to respond to any other activity that may expose us or you or any other user to legal or regulatory liability (more information on ProxiVie's Law Enforcement Guidelines here), (iv) to enforce and administer our agreements with users; or (v) to protect the rights, property or personal safety of ProxiVie, its employees, its users or members of the public. For example, if it is possible under one of the preceding circumstances, tax information concerning a service provider may be communicated to the tax administration or other public authorities.

Where appropriate, we may notify users of the existence of legal requests, unless: (i) notification is prohibited by the legal process itself, by a court order we receive, or by applicable law ; or (ii) we believe that the notification is unnecessary, ineffective, would cause a risk of injury or bodily harm to an individual or group, or create or increase the risk of fraud against, or harm to, ProxiVie , our users, or expose ProxiVie to a claim for obstruction of justice.

Regarding the jurisdictions in which ProxiVie facilitates the collection and remittance of taxes when permitted by law, we are entitled to disclose the information of service providers and customers in relation to transactions, reservations, and taxes to the competent tax authorities, such as the names of service providers and customers, addresses, dates and amounts of transactions, tax identification number(s), amount of taxes received (or due).

Service providers.

We share personal information with affiliated and unaffiliated service providers to help us run our business, including with service providers that help us: (i) verify your identity or authenticate your credentials; (ii) compare the information with public databases; (iii) conduct reference or criminal background checks for fraud prevention and risk assessment; (iv) conduct product development, maintenance and debugging; (v) enable the provision of ProxiVie services through third-party software platforms and tools (for example, by integrating with our APIs); (vi) to provide user support, advertising or payment services; (vii) process, administer or assess insurance or similar claims; or (viii) facilitate charitable and non-profit activities consistent with ProxiVie's mission. These service providers are contractually bound to protect your personal data and only have access to it to perform the tasks mentioned above.

Business operations

We reserve the right to disclose and transfer your information, including your personal information:

To a successor owner, co-owner or operator of the ProxiVie platform or database.

In connection with a corporate merger, consolidation, sale of substantially all of our membership interests and/or assets or any other corporate change, including to any potential purchaser.

OTHER IMPORTANT INFORMATION

Analysis of your communications.

We may consult, examine or analyze your communications on the ProxiVie Platform for the reasons set out in the "Our use of the information we collect" section of this policy, in particular in the context of fraud prevention, risk assessment, compliance regulatory, investigative, product development, research, analysis, enforcement of our Terms of Service and user support. For example, as part of our fraud prevention efforts, we scan and analyze messages to hide contact details and references to other websites. In some cases, we may also browse, review, or analyze messages for purposes of debugging, improving, and expanding our product offerings. We use automated methods whenever possible. From time to time we may need to review communications manually, for example in the context of fraud investigations and user support, or to assess and improve the functionality of these automated tools. We will not review, monitor or analyze your communications to send you marketing messages from third parties, and we will not sell reviews or analyzes of such communications.

Third Party Partners and Integrations.

Certain parts of ProxiVie may link to third-party services that are not owned or controlled by ProxiVie, such as Google Maps. Use of these services is subject to the privacy policies of those providers.

YOUR RIGHTS

You may exercise any of the rights described in this section in accordance with applicable law. Please note that we may ask you to verify your identity before acting on your request.

Management of your information.

You can view and update some of your information by accessing your Account settings. If you have connected your ProxiVie account to a third-party service, you can modify your settings and disconnect from this service by accessing your Account settings. You are responsible for keeping your personal information up to date.

Data Access and Portability.

In some jurisdictions, applicable law may give you the right to request copies of your personal information or information about how we process your personal information, or to request copies of the personal information you have provided to us within a structured, commonly used and machine-readable format, and/or to request that we transmit this information to another service provider (where technically feasible).

Data disposal.

In some jurisdictions, you can request deletion of your personal information. Please note that if you request the deletion of your personal information:

We may, in any case, retain personal information as necessary for our legitimate business interests, such as detecting and preventing fraud and improving security. For example, if we suspend a ProxiVie account for fraud or security reasons, we may retain certain information relating to this ProxiVie account to prevent the concerned  member from opening a new ProxiVie account in the future.

We may retain and use your personal information to the extent necessary to comply with our legal obligations. For example, ProxiVie may retain some of your information for tax purposes, legal reporting and auditing.

The information that you have shared with other people (eg: comments, posts on a forum) may remain public on the ProxiVie platform even after the deletion of your ProxiVie account. However, this information will no longer be assigned to you. Copies of your information (eg connection records) may remain in our database, but separately from personal identifiers.

Because we protect information from accidental or malicious loss and destruction, residual copies of your personal information may not be deleted from our backup systems for a limited period of time.

How to access your information

 If you have an online customer account with us, you have the ability to view and update your personal information online by logging into your account. You can also view and update your personal information by contacting us. More information on how to contact us is provided below.

You can also choose to deactivate your account by contacting us at info@proxivie.com. After deactivating your account, you will no longer be able to log in to our website or access your personal information. However, you can open a new account at any time. If you deactivate your account, we may still retain certain information associated with your account for analysis and record-keeping integrity purposes, as well as to prevent fraud, collect fees owed, enforce our terms and conditions, take actions we deem necessary to protect the integrity of our website or our users, or take other action otherwise permitted by law. Additionally, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to the policies of those third parties.

Your choices regarding the collection and use of your information

At any time, a consumer user may opt out of receiving commercial or promotional emails or newsletters from us by accessing your user account and unsubscribing. You will also have the option in any commercial e-mail we send to you to opt out of receiving such messages in the future. Processing an unsubscribe request can take up to 10 days. We may send you other types of transactional and relational email communications, such as service announcements, administrative notices, and surveys, without offering you the opportunity to opt out of receiving them.

It is important for you to protect yourself against unauthorized access to your account password and your computer. Be sure to log out of your account or close your browser after completing your visit to our site.

Please note that despite our reasonable efforts, no security measures are ever perfect or impenetrable, so we cannot guarantee the security of your personal information.

COMPLIANCE WITH THE CHILDREN'S ONLINE PRIVACY ACT

We do not collect any information from anyone under the age of 16. The ProxiVie platform, as well as the products and services offered through it, are all aimed at people aged 16 and over. If you are under 16, you are not authorized to use the ProxiVie platform.

SECURITY

Although no organization can guarantee perfect security, we continuously implement and update administrative, technical and physical security measures to protect your information against unauthorized access, loss, destruction or alteration.

For example, when you enter a credit card number, we encrypt that information in transit over the Internet and in storage. However, none of these measures are 100% secure.

HOW WE PROTECT THE PERSONAL INFORMATION WE COLLECT

The security and privacy of your personal information is important to us. We have implemented technical, administrative and physical security measures to protect your personal information against unauthorized access or disclosure and inappropriate use.

For example, when users book services, the information they enter is encrypted using TLS encryption. We do not store credit card information on our servers and we use TLS encryption to protect your credit card information while it is transferred to our third-party payment processor. In addition, access to your personal information is restricted in our offices. Only employees who need the personal information to perform a specific job, for example, sales representatives, managers and customer service personnel, have access to the personal information. All employees with access to personal information are kept informed of our security and privacy practices. After a new policy is added, these employees are informed and/or reminded of the importance we place on privacy and what they can do to improve the protection of our users.

CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this Privacy Policy at any time in accordance with applicable law. Where appropriate, we will post the revised Privacy Policy and update the “Last Updated Date” at the top of the Privacy Policy. In the event of a major modification, we will also inform you by e-mail at least thirty (30) days before the date of entry into force of the new version. We recommend that you check our website from time to time to inform yourself of any changes to this Privacy Policy or any of our other policies. If you do not agree with the new terms of the Privacy Policy, we invite you to delete your Account.
